For example, this Policy applies to information that you may provide when you visit our websites that link to this Policy including, www.milwaukeetool.com, www.stiletto.com, www.empirelevel.com, www.imperialblades.com, www.connect.milwaukeetool.com, www.onekey.milwaukeetool.com, www.milwauketoolswag.com, and www.milwaukeetool.jobs (our "Websites"), when you use and access the ONE-KEY™ platform from our Websites, when you install, access or use the ONE-KEY™ mobile application or other mobile and desktop apps that may be downloaded from our Websites, or apps provided by or on behalf of Company through an online app store (the "Apps"), or when you use certain Milwaukee tools and equipment that are ONE-KEY™ enabled (“ONE-KEY™ Tool”).

Please read this Policy carefully to understand our policy and practices regarding your personal information and how we will treat it. If you do not agree with this Policy, your choice is not to use the Apps or our Websites. By accessing or using the Apps or our Websites, you agree to this Policy. This Policy may change from time to time. Your continued use of the Apps or our Websites after we make changes is deemed to be acceptance of those changes, so please check this Policy periodically for updates.

Children

The Apps and our Websites are not intended for children under the age of majority in their jurisdiction of residence. No one under the age of majority or age 18 may provide any information to or on our Websites or Apps. We do not knowingly collect personal information from children. If you are a child, do not use or provide any information on or through the Apps or on or through our Websites. If we learn we have collected or received personal information from a child without verification of parental consent, we will delete that information. Categories of Information That May Be Collected 

In addition to any of the practices discussed within this Policy, the Company may collect or has collected in the past twelve (12) months the categories of personal information about you, described below.

  • Identifiers and information about you, such as name, postal address, e-mail address, telephone number, employee ID or any other identifier by which you may be contacted online or offline ("personal information").
  • Commercial information, such as products or services purchased and information relating to your use of our services.
  • Internet or other similar network information, such as IP address, browser type and version, type of device you use, operating system version, device identifier, geographic location, pages you view, how you got to our Websites and any links you click on to leave our Websites, metadata and user behavioral metrics about your use of our Websites, emails, SMS/text, and push notifications we send to you (including clicks and opens), and metadata about how you interact with our Websites.
  • Tracking information such as Cookies, web beacons, pixels, tags, scripts and other similar technologies.
  • Communications, such as telephone conversations, email communications, etc.
  • Financial information, such as payment information when you purchase some of our products and Services.
  • Professional and employment information, such as education and other background information when you inquire about employment. 
  • Account information, such as a username and password for an account with us. 
  • Product and App usage information, such as geo-location information, information regarding how you use our App, information you share with the App on your phone (such as audio, photo, or video files), or information regarding how our products or tools function or are used (such as how long a tool is used, when a tool is used, and any issues that occurred while in use). Please note this only applies to some Milwaukee Tool tools, such as ONE-KEY™ Tools.

Collection Of Information and Geo-Location By ONE-KEY™ Tools

ONE-KEY™ Tools send out a Bluetooth signal that can be detected by nearby devices, such as cell phones.  These devices associate their geo-location to your ONE-KEY™ Tool and send that data to the ONE-KEY™ App.  The ONE-KEY™ App may then send you a “Notification” with your ONE-KEY™ Tool’s serial number, tool type, and geo-location.  App users may only access and view the Notifications associated with the ONE-KEY™ Tools registered to their ONE-KEY™ account.

Only authorized users of your account can see where your ONE-KEY™ Tool is.  Your ONE-KEY™ Tool’s and phone’s geo-location data and history are never stored in the ONE-KEY™ Tool itself.  

Information Collected Automatically and Additional Tracking Information

As you navigate through and interact with our Websites, or when you download, access and use the Apps, we may use automatic data collection technologies. An example of such technology would be the use of browser cookies, web beacons, or pixels (each, a “tag”). We use tags across a variety of marketing platforms which may include, but is not limited to, email delivery, analytics platforms and advertising. We may use Google Analytics to help us understand how our customers interact with the Sites. You can also prevent Google Analytics from recognizing you on return visits to this site by disabling cookies on your browser.

The type of such automatically collected information includes:

  • Usage Details. When you access and use the Apps or Websites we may automatically collect certain details of your access to and use of our Websites or Apps, including traffic data, location data, tool connection and performance data, logs and other communication data and the resources that you access and use on or through the Apps or Websites.
  • Computer Information. Information about your computer and internet connection, including your IP address, operating system and browser type.
  • Device Information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information and the device's telephone number.

How We Use Your Information

In general, we use your information to:

  • Provide you with the Apps and its contents.
  • To present our Websites and its contents to you.
  • To give you notices about your account and our products.
  • To provide you with information, products or services that you request from us, including by electronic commercial messages.
  • To provide you with marketing information, such as offers regarding Company related products or services or notifications about special promotions or contests.
  • To comply with law and enforce our terms and contracts.
  • To process and provide Company products and services to you
  • To evaluate employment.
  • To improve and develop products, Apps, and our Websites.
  • To secure our products, Apps, and our Websites.
  • In connection with a sale, merger, acquisition or corporate reorganization.
  • In any other way we may describe when you provide the information.
  • As otherwise described in this policy and for any other purpose with your consent.


 Additionally, if you are a user of the Apps and decide to use the Apps to link to your ONE-KEY™ Tools, we can use the information to:

  • Track performance data of a particular ONE-KEY™ Tool or suite of ONE-KEY™ Tools owned by you and used with the Apps or Websites.
  • Provide support and repair service to you regarding your ONE-KEY™ Tools.
  • Prepare reports and logs of ONE-KEY™ Tool use, performance, and track battery life of ONE-KEY™ Tools.
  • Unlock your ONE-KEY™ Tool on your behalf at your request.

If you use a ONE-KEY™ Tool, the geo-location of the ONE-KEY™ Tool may be detected and transmitted by any phones utilizing the ONE-KEY™ App in the surrounding area and to other internet enabled devices that the Company has authorized to be part of the ONE-KEY™ system and sent to us. If that ONE-KEY™ Tool is associated with the ONE-KEY™ App, we will use this information and geo-location to provide you information about your ONE-KEY™ Tool through your ONE-KEY™ App. If the Notification information and geo-location is not associated with a specific user, we will use that information for our analytical purposes, to develop and improve products and services, and internal business purposes. 

Disclosure Of Your Information

We will disclose your personal information provided to us to any other person as specified at the point of collection and as otherwise set out in this policy. We may also disclose your personal information as you direct us to or where you have consented to such disclosure. We may use and disclose aggregated or de-identified information about our users, and information that does not personally identify any individual, without restriction. We may disclose, and have disclosed in the past 12 months, personal information to the following third parties:

Additionally, any material you voluntary provide on our Websites or Apps for public comment, review, or otherwise provide outside your individual user account is provided on a non-confidential and non-proprietary basis and we can use, reproduce and publish the information without restriction.

We do not sell (as defined by applicable U.S. state privacy laws) personal information to any third party. However, when you interact with our Websites or Apps, we may use, or authorize third-party partners and service providers to use, cookies, web beacons and similar technologies to improve your experience with us. Such tracking information can collect personal information about you that can be used by us and our authorized third-party partners and service providers.  Our disclosure of your personal information in this way may constitute “sharing” or using for “targeted advertising” under applicable U.S. state privacy laws.

To the extent this is considered “sharing” or “targeted advertising”, in the preceding 12 months, we have shared the following categories of personal information for the purpose of showing you ads about Milwaukee Tool’s services and products and understanding how you use our Website and Apps:

Response Timing, Verification and Format

Only you, or a person or entity that you authorize to act on your behalf, may make a verifiable request related to your personal information. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  In order to verify your identity, we will generally require the matching of sufficient information you provide us to the information we maintain about you in our systems. If you are using an authorized agent, please note that you will be required to verify your identity and provide written confirmation that you have authorized the agent to make a request on your behalf. Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

We endeavor to respond to most verifiable consumer requests within 45 days of receipt.  If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  If you have an account with us, we will deliver our written response to that account.  If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. The response we provide will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

From time to time, the Company may provide links to other third party websites or applications that it does not control, or the Company may include functionality that allows certain kinds of interactions between the site or application and your account on a third-party website or application. The use of this functionality may involve us to provide information to a third-party website or application.
